Cookie Policy

This information, pursuant to Article 13 of the European Regulation 2016/679 of the European Parliament and of the Council, is provided in accordance with the provisions of Italian Legislative Decree 196/2003 and subsequent amendments, the Provision of the Italian Data Protection Authority no. 231 of June 10, 2021, as well as Directive 2002/58/EC of the European Parliament and of the Council.

What are Cookies?

Cookies are strings of text that websites (so-called Publishers, or “first parties”) visited by the user, or different websites or web servers (so-called “third parties”), place and store — directly, in the case of publishers, or indirectly, through the latter, in the case of “third parties” — on a terminal device available to the user. Such terminal devices include, for example, a computer, tablet, smartphone, or any other device capable of storing information.

Internet browsing software and the operation of these devices, such as browsers, can store cookies and later retransmit them to the websites that generated them upon a subsequent visit by the same user, thereby retaining memory of their previous interaction with one or more websites.

The information encoded in cookies may include personal data, such as an IP address, a username, a unique identifier, or an email address, but may also contain non-personal data, such as language settings or information about the type of device used to browse the site.

Cookies therefore perform important and varied functions, including session tracking, storing information about specific configurations regarding users accessing the server, facilitating the use of online content, etc. They can be used, for example, to keep track of items in an online shopping cart or the information entered in a web form.

Through cookies, it is possible, among other things, to allow web pages to load faster, as well as to route information across a network — functions strictly related to the operability of websites themselves. Cookies can also be used to deliver behavioral advertising (“behavioural advertising”) and measure the effectiveness of advertising messages, or to tailor the type and method of services offered based on users’ previously observed behavior.

Types of Cookies

Italian legislation (Art. 122 of Legislative Decree 196/03 “Code on the Protection of Personal Data”, hereinafter “Privacy Code”) implemented EU Directive 2009/136/EC, which requires website operators using cookies or other tracking technologies to inform users about the types of cookies used by the site.

With Provision no. 231 of June 10, 2021, published in the Official Gazette no. 163 of July 9, 2021, the Italian Data Protection Authority classified cookies into two main categories: “technical” cookies and “non-technical” cookies.

Technical Cookies

These are installed by the website owner or manager for the purpose of <<carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such service>> (Art. 122, paragraph 1, of the Privacy Code). The installation of Technical Cookies does not require prior user consent.

First-party and Third-party Analytics Cookies

They are considered equivalent to cookies and other technical identifiers only if:

  • they are used solely to produce aggregated statistics relating to a single website or a single mobile application;
  • in the case of third-party cookies, at least the fourth component of the IP address is masked;
  • third parties refrain from combining the minimized analytics cookies with other processing (e.g., customer files or statistics of visits to other sites) or transmitting them to further third parties. However, third parties are allowed to produce statistics with data relating to multiple domains, websites, or mobile applications belonging to the same publisher or business group.

The controller who carries out their own statistical processing of data relating to multiple domains, websites, or mobile applications attributable to them may also use non-anonymized data, provided the purpose limitation principle is respected.

Non-technical Cookies

These are used to associate specific actions or recurring behavioral patterns in the use of functionalities (patterns) with identified or identifiable individuals, in order to group different profiles within homogeneous clusters of varying size, thereby enabling increasingly personalized service delivery, as well as the sending of targeted advertising messages consistent with the user’s online browsing preferences.

They are referred to in Article 122 of the Privacy Code, which provides that <<the storage of information in the terminal equipment of a contracting party or user or access to information already stored is only permitted if the contracting party or user has expressed their consent after being informed using the simplified procedures set out in Article 13, paragraph 3, of the Privacy Code>> (Art. 122, paragraph 1, of the Code).

The Authority also classified cookies based on the entity acting as the controller of the personal data collected by the cookie, distinguishing between “first-party” and “third-party” cookies.

First-party Cookies

These are managed by the website owner. For such cookies, the obligation to provide information rests with the site owner, who is also responsible for specifying how to block the cookie if desired.

Third-party Cookies

These are managed by a third party different from the site owner. For such cookies, the obligation to provide information and to specify how to block them lies with the third party. The site owner must include the URL where such information is available.

In both types of cookies (first-party or third-party), the collection of consent — necessary in the case of profiling cookies — takes place via a specific banner on the website’s homepage.

Types of Cookies Used by the Platform

This platform uses technical cookies, which can be used without the consent of the data subject, as they are strictly necessary for the provision of the service. Furthermore, third-party profiling cookies may be used, whose use is subject to the consent directly granted to those third parties by accessing their respective cookie policies. Profiling cookies may be used by the data controller or the cookie owner to store user preferences, provide personalized or optimized features, or record their habits and preferences expressed during browsing. For example, profiling cookies may be used to offer online services, send advertising tailored to users’ interests, or prevent them from being offered services they previously refused.

The next section of this Cookie Policy provides a detailed list of all cookies used by the platform.

The first group lists the so-called technical cookies, whose use does not require user consent.

The second group lists the profiling cookies.

For both groups, the following information is provided for each type of cookie:

  1. name of the cookie
  2. purpose/function of the cookie
  3. cookie duration
  4. indication of whether the cookie is first-party or third-party
  5. if the cookie is third-party, the link to the third party’s site where its cookie policy and blocking instructions are available
