Terms of Use – Dabliu Notes

Effective date: October 8, 2025

Welcome to Dabliu Notes. Please read these terms carefully—they govern your use of our mobile application for iPadOS and Android (the “App”), our website dabliunotes.com (the “Site”), and related services, features, and content (collectively, the “Services”).

The Services are provided by Wacebo Europe Srl (VAT 12404241007) (“Wacebo,” “we,” “us”). For questions or notices: [email protected] .

These Terms form a binding contract between you and Wacebo. By using the Services, you agree to these Terms and to our Privacy Policy (available in the App/Site).

1) Scope and Modes of Use

  • Individual Mode. Use of the App on personal devices with an account you create via Sign in with Apple or Google Sign-In.

  • Institutional Mode (School/Enterprise). Accounts created and managed by a school or organization (the “Institution”), which may apply its own policies (e.g., credential management, access, retention). Certain features may differ.

Unless stated otherwise, “Services” refer to Individual Mode.

2) Changes to the Terms

We continually improve the Services and may update these Terms. If we do, we’ll notify you in the App/Site or by email. If you don’t accept the changes, you must stop using the Services. Continued use after the effective date means you accept the updated Terms.

3) Privacy

Data protection matters to us. Please review our Privacy Policy (EU/UK/USA) for purposes, legal bases, your rights, and our processors (e.g., OVH – servers in France; Google Firebase – analytics; Sentry – crash reporting; Amazon S3 Europe – storage). In Institutional Mode, additional privacy terms agreed with the Institution may apply.

4) Eligibility and Minors

  • Individual Mode: the Services are not intended for users under 16. We do not knowingly collect data from children under 16 in this mode. In the USA, we do not collect data from children under 13 (COPPA).

  • Institutional Mode: minors may use the Services only via accounts created by an Institution, which ensures it has a valid legal basis and, where required, parental consent, and provides the necessary notices.
    If you believe a child has created an account in violation of this section, contact us at [email protected] .

5) Account and Security

To use the Services you may need to create an account and password or authenticate via Apple/Google. You must provide accurate information and keep it up to date. You’re responsible for all activity on your account and for safeguarding your credentials and devices. Sharing your account without authorization is prohibited.

6) Messaging

We may send you service and legal notices (e.g., technical/transactional emails). You can manage preferences where available; essential notices may not be disabled.

7) Permitted Use and Prohibited Conduct

You agree not to:

  • violate laws or third-party rights (IP, privacy, publicity);

  • bypass or compromise security/restrictions, attempt unauthorized access, or probe vulnerabilities;

  • upload or transmit malware, “spam,” or run automated processes that overload the Services;

  • perform unauthorized scraping/crawling or reverse engineer the Services;

  • use the Services to build a competing product;

  • upload/store Prohibited Data, including:

    • identifiable health information;

    • non-public government ID numbers;

    • sensitive financial data or full payment card numbers;

    • children’s personal data without a valid basis/consent;

    • special category data under GDPR (e.g., racial/ethnic origin, political opinions, etc.) and criminal records data;

  • upload prohibited content: pornographic, child sexual abuse material, sexually explicit content, hate/violent/extremist content, fraudulent content, exploitation of minors or animals, defamatory, obscene, illegal, or otherwise unacceptable by reasonable standards.

Violations may result in suspension or termination of your account.

8) Ownership of the Services

The Services and materials made available through them (code, text, images, trademarks, logos) are owned by Wacebo and/or its licensors and protected by law. We grant you a limited, non-exclusive, non-transferable license to use the App and content solely to access the Services in accordance with these Terms.

9) User Content (Notes)

Definitions

“User Content” means notes, strokes, text, images, and other materials you upload or save in your account.

Ownership

You retain ownership of your User Content.

License to Wacebo (Service Operation)

To operate the Services, you grant us a worldwide, non-exclusive, transferable, sublicensable, royalty-free, perpetual license to host, reproduce, translate, technically modify, process, perform, and display your User Content solely to:

  • provide, maintain, secure, and improve the Services (e.g., backups, transcoding, multi-device rendering);

  • comply with law and enforce these Terms.

No social features: your content is not published or made available to other users through our Services, unless you export or share it outside the App. You do not grant any license to the public or to other users via our Services.

Feedback

If you send us ideas or suggestions (“Feedback”), we may use them freely without obligations to you.

Moderation

We do not perform systematic pre-moderation; we reserve the right (not the obligation) to remove unlawful or violating content and to suspend accounts.

10) Third-Party Services

The Services may integrate third-party services (e.g., Apple/Google for login, Firebase for analytics, Sentry for crash reporting, OVH and Amazon S3 for hosting/storage). Your use of such services may be subject to their terms and privacy policies. We aren’t responsible for third-party content, practices, or availability.

11) Changes, Suspension, and Availability

We may modify or discontinue features at any time. For material changes that adversely affect you, we’ll try to provide reasonable notice. We may suspend or terminate accounts for violations or abuse. The Services are provided “as is” and may experience interruptions.

12) Fees and Refunds

The Services are currently free. If we later introduce paid services, we’ll notify you and you can choose whether to opt in. Any in-app payments would be handled exclusively by the stores (Apple App Store / Google Play) under their terms.

13) App Stores and Platforms

These Terms apply to the App downloaded from app stores. You acknowledge that:

  • Apple/Google are not parties to these Terms and are not responsible for the App;

  • the App is licensed for your personal use on devices you own/control;

  • Apple/Google have no obligation to provide support or warranties; any refunds are governed by the store;

  • Apple/Google are third-party beneficiaries only to the extent required by their policies and may enforce applicable provisions.

14) Data Export and Account Closure

You may stop using the Services at any time. To export your data or request deletion, email [email protected]

(we may need to verify your identity). After closure, we may retain some data as required by law or to enforce rights. Please export your notes before closure.

In Institutional Mode, also contact your Institution for export/deletion under its policies.

15) Warranties and Liability

Disclaimer. The Services are provided “as is” and “as available,” without express or implied warranties (including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability) to the extent permitted by law.

Limitation of Liability. To the maximum extent permitted:

  • we will not be liable for indirect, incidental, special, punitive, or consequential damages (including lost profits, data loss, goodwill, business interruption);

  • our aggregate liability to you is limited to the greater of €100 or the amounts you paid Wacebo for the Services in the 12 months preceding the claim (currently €0 for free Services).

This section does not limit liability that cannot be excluded by law (e.g., willful misconduct or gross negligence, personal injury due to product defect) and does not affect non-waivable consumer rights.

16) Indemnity

You agree to indemnify and hold Wacebo harmless from claims, damages, and costs (including reasonable legal fees) arising from: (a) your use of the Services in violation of these Terms or law; (b) User Content that infringes third-party rights.

17) Governing Law and Venue

These Terms are governed by Italian law. Any dispute shall be brought exclusively before the Court of Bari, without prejudice to any mandatory consumer rights allowing you to litigate in the courts of your residence/domicile and to protections under EU/UK/US consumer laws where applicable.

18) Miscellaneous

  • Assignment. You may not assign these Terms or your rights/obligations without Wacebo’s written consent. We may assign freely.

  • Severability. If any provision is invalid, the remainder remains in effect.

  • No Waiver. Failure to exercise a right is not a waiver.

  • Entire Agreement. These Terms and the Privacy Policy are the entire agreement on this subject and supersede prior understandings.

  • Language. The Italian version prevails. Translations may be provided for convenience.

Annex A – Institutional Mode (School/Enterprise)

1. Scope. The Institution creates and manages accounts. It may apply MDM/device-management policies and restrict features (e.g., disable exports).

3. Minors. The Institution ensures valid legal bases and, where required, parental consent (COPPA/local laws).
4. Content and License. The same limited license to Wacebo necessary to operate the Services applies. No public publishing via the Services.
5. Rights Requests. Data subjects may exercise their rights through the Institution and/or Wacebo.
6. Termination and Portability. Upon termination with the Institution, it may request export/deletion per the DPA and applicable law.
